Please review this “Parent Waiver, Release of Liability and Consent Form” carefully, as it includes important information about your legal rights and responsibilities.
PARENT WAIVER, RELEASE OF LIABILITY & CONSENT FORM
This Waiver/Release (“Release”) is between Ashm Artorium LLC (“Ashm Artorium”) and the undersigned adult participant and/or parent/guardian.
1) Acknowledgment of Activities & Assumption of Risk
I understand that art classes, workshops, studio sessions, camps, parties, and related activities (“Activities”) may involve inherent risks, including but not limited to:
Use of art supplies and materials (e.g., paint, inks, dyes, glues, clay, plaster, epoxy/resin, solvents, aerosols, sealers) that may cause allergic reactions, illness, irritation, or injury if misused.
Use of tools/equipment (e.g., scissors, wire, sculpting tools, hand tools) which may cause cuts, punctures, or other injury.
Slip/trip/fall, collisions, accidental contact with others, and other risks associated with moving around a studio environment.
Property damage to personal items (clothing, shoes, phones) due to paint/materials.
I understand these risks may occur even with supervision, safety rules, and reasonable care. Participation is voluntary. I agree to follow all safety instructions and studio rules.
2) RELEASE OF LIABILITY (ORDINARY NEGLIGENCE ONLY)
IN CONSIDERATION FOR BEING PERMITTED TO PARTICIPATE, I AGREE TO THIS RELEASE.
To the fullest extent permitted by Minnesota law, I WAIVE AND RELEASE Ashm Artorium LLC and its owners, managers, employees, instructors, volunteers, agents, and (if applicable) the property owner/landlord of the premises where Activities occur (collectively, “Released Parties”) FROM ANY AND ALL CLAIMS for injury, death, or property damage arising out of or related to participation in the Activities TO THE EXTENT CAUSED BY THE ORDINARY NEGLIGENCE of the Released Parties.
3) Release for Minor — Parent/Guardian Agreement
If the participant is a minor, I certify I am the minor’s legal parent/guardian and have authority to sign.
I agree:
This Release applies to my own claims arising from or related to the minor’s participation (including claims for medical expenses I pay).
I understand Minnesota law may limit a parent’s ability to waive certain claims belonging to a child; however, I intend this Release to be interpreted to provide the maximum protection permitted by law while respecting the limitations stated above.
4) Medical Authorization & Emergency Care Consent
If I (or my child) is injured or becomes ill, I authorize Ashm Artorium to:
Provide basic first aid within staff capabilities, and/or
Call 911 and seek emergency medical treatment.
I understand I am financially responsible for medical costs. I confirm I have medical insurance or accept responsibility for medical expenses.
5) Studio Rules, Safety & Removal
I agree that Ashm Artorium may set safety rules, restrict tool use by age/skill, and refuse participation or remove a participant from an Activity for unsafe, disruptive, or inappropriate behavior, without refund (consistent with the refund policy below).
6) Photography / Video / Artwork Use
I grant Ashm Artorium permission to photograph and/or record my child and my child’s artwork, and to use those photos/videos to (1) share with me for progress updates and (2) for promotional, educational, and/or marketing purposes on Ashm Artorium’s website and Ashm Artorium’s Social media accounts. This consent remains in effect unless I revoke it in writing.
7) Refund & Make-Up Policy
I understand and agree:
No refunds are issued for any reason, including missed classes or early withdrawal.
Scheduled Attendance: Classes should be attended on the schedule for which you are enrolled.
Make-Up Classes (Limited): For 4-week or 8-week enrollments, if a class is missed due to vacation or urgent circumstances, I must notify Ashm Artorium at least one (1) hour before the scheduled start time. With timely notice, a make-up may be scheduled subject to availability and must be completed within the enrollment period (4 or 8 weeks, as applicable).
No-Shows / Insufficient Notice: Missed classes without notice or with less than one (1) hour notice are not eligible for a make-up.
Ashm Artorium may cancel/reschedule a session for instructor illness, weather, facility issues, or emergencies; in that event, we will offer a make-up class.
8) Drop-Off / Pick-Up
Ashm Artorium is not a daycare and does not provide childcare. The parent/guardian is responsible for the child’s safe arrival and departure.
